1 Scope of Application

These General Terms and Conditions (GTC) govern the use of the platform "Pipeup", a product of Network Ventures eGen (hereinafter "Pipeup", "we" or "us"), and apply to all users and organizers who publish content on pipeup.live or use the platform. These GTC apply worldwide, including in Germany and other international markets where Pipeup is distributed.

2 Service Description

Pipeup is a platform that enables users to post content such as texts and images in real-time on digital display surfaces (e.g., LED walls in stadiums) and on users' client devices. Additional features include voting options (e.g., Man of the Match), the ability to receive and redeem vouchers, as well as anonymous collection and analysis of audience emotions. Advertising can also be displayed beneath users' posts/images.

Content created by users is reviewed by an editorial team and automatic filters (including a bad-word filter and AI-supported checks) before publication. In some cases, content is also published without prior manual review.

3 Registration and Use

3.1 Registration

Using Pipeup may require registration, during which the user creates an user account. The information provided must be truthful and complete. The user is obligated to keep their access data secret and is responsible for the security of their account.

3.2 Use by Minors

Pipeup may only be used by minors under the following conditions:

• 

  Users under 14 years of age may submit posts or snaps only with the verifiable consent of a parent or legal guardian.

• 

  Users aged 14 to 18 confirm that they have obtained parental consent for uploading snaps (images, photos) that depict themselves.

• 

  Uploading photos of children or minors by third parties is prohibited unless verifiable parental consent has been obtained for every identifiable minor in the image.

Pipeup and organizers reserve the right to request proof of parental consent and may delete content or suspend accounts in case of doubt.

3.3 User Behavior

The user undertakes not to post content when using the platform that:

• 

  Violates third-party rights (e.g., copyrights, trademark rights),

• 

  Violates applicable law or public morals,

• 

  Is offensive, insulting, discriminatory, or otherwise inadmissible.

Organizers (e.g., football clubs or event managers) are responsible for ensuring that no illegal content is published and that content is reviewed in advance and removed or not approved when necessary.

3.4 Misuse of Usernames

It is prohibited to use usernames that are suitable for imitating other persons or impersonating another person, particularly celebrities, Pipeup employees, or other public figures. Such actions may lead to immediate measures, including blocking of the respective account.

3.5 Prohibition of Spam

Sending unwanted mass messages (spam), repeatedly posting identical or similar content, and linking to harmful or misleading websites is prohibited. Users who violate this prohibition may be blocked without warning.

3.6 Prohibition of Violence and Harassment

Publishing content that glorifies violence, incites violence, represents sexual harassment, or is otherwise threatening or harassing is strictly prohibited. Such content will be immediately removed, and the responsible user may be permanently excluded from the platform.

3.7 Prohibition of Technical Attacks

Any attempts to manipulate the platform, including hacking, DDoS attacks, introducing malware, or other forms of technical attacks, are prohibited. Such actions may be prosecuted criminally and lead to immediate blocking of the user account.

3.8 Measures for Violations

Pipeup reserves the right to take appropriate measures in case of violations of these GTC or legal provisions. These include, among others:

• 

  Temporary or permanent blocking of the user account,

• 

  Removal or blocking of content,

• 

  Initiation of legal proceedings.

4 Rights to Content

4.1 Usage Rights to Content

The user grants Pipeup and the respective organizer (rights holder of the respective Pipe) a simple, non-exclusive, time-limited usage right to the content transmitted by the user. This includes in particular posts (including name and message) as well as snaps (images/photos).

The use is exclusively for the following purposes:

• 

  Display on digital display surfaces in the stadium or venue,

• 

  Presentation on end users' devices (e.g., in the app or web application),

• 

  Use in social media channels and newsletters of the organizer or Pipeup itself, provided these contents belong to the respective event (Pipe).

Important restrictions and conditions:

• 

  The use of content for social media or newsletters is contextually restricted to the event the content was submitted to.

• 

  Use of content in social media channels or newsletters is strictly limited to the official channels of the organizer and/or Pipeup. Advertising partners, sponsors, commercial partners or any other third parties are explicitly excluded from using or republishing user-generated content.

Rights remain with the user, and commercial exploitation by Pipeup or third parties outside the above-mentioned framework does not take place.

4.2 User Warranties

The user warrants that they hold all necessary rights to all submitted content and do not violate any third-party rights. This applies particularly to any uploaded snaps (images/photos). Furthermore, users may only upload images in which they appear themselves or for which they have explicit permission from all identifiable individuals. The user indemnifies Pipeup and the organizer from all third-party claims arising from the use of the content.

5 Disclaimer and Indemnification

5.1 Pipeup's Liability

Pipeup provides the platform and technical infrastructure but assumes no liability for content published by users. The organizer is solely responsible for the content and its lawful use. Pipeup is not liable for:

• 

  Damages arising from incorrect or incomplete content,

• 

  Violations of third-party rights (particularly copyright, trademark, or personal rights),

• 

  Incorrect or failed review of content by the organizer or editorial team.

5.2 Indemnification

The organizer indemnifies Pipeup and its employees, partners, and representatives from all claims, lawsuits, losses, liabilities, damages, and costs arising from the publication of content by the organizer or users.

6 Advertising and Monetization

Pipeup enables organizers to display advertising content in the background and alongside users' posts and images. The responsibility for advertising and its legal admissibility lies with the organizer. Pipeup assumes no liability for the content of displayed advertising.

User-generated content may not be used by advertising partners or sponsors. While advertising may be displayed alongside posts and snaps, advertisers do not receive usage rights to user-generated content.

7 Technical Availability

Pipeup strives for the most uninterrupted availability of the platform possible but does not guarantee continuous availability or error-free operation of the services. Pipeup is not liable for damages arising from technical failures or delays.

8 Changes to the GTC

Pipeup reserves the right to change these GTC at any time. Changes will be announced to users through appropriate notification on the website. Changes are considered accepted if the user continues to use the platform after the change.

9 Data Protection

The processing of personal data is carried out in accordance with the Privacy Policy, which is part of these GTC.

10 Final Provisions

10.1 Applicable Law

The law of the Republic of Austria applies. The place of jurisdiction for all disputes in connection with these GTC is Innsbruck, Austria.

10.2 Severability Clause

Should a provision of these GTC be wholly or partially invalid, the validity of the remaining provisions remains unaffected.

Such actions lead to immediate blocking of the user account and possibly legal consequences.
